In July 2025, just months before that target window closed, Krafton fired studio CEO Ted Gill along with co-founders Charlie Cleveland and Max McGuire “effectively immediately.” Krafton’s public statement accused the trio of abandoning their responsibilities and causing significant development delays. Subnautica 2’s Early Access launch was simultaneously delayed to 2026.

The fired founders fought back. In court filings, they alleged that Krafton’s plan to avoid the $250 million payout had been conceived with the help of ChatGPT by Krafton’s CEO Changhan Kim after Krafton’s own legal team had warned him that the payment had to be made even if the founders were dismissed with cause. The lawsuit claimed the firings were a deliberate scheme to dodge the bonus by removing the founding team before the earnout period closed.

The story went global. The gaming community was furious. And then, in March 2026, a Delaware court ruled in the founders’ favour.

The judge found that Krafton had “breached the EPA (Equity Purchase Agreement) by terminating the key employees without valid cause and by improperly seizing operational control of Unknown Worlds.” Ted Gill was reinstated as CEO. The $250 million earnout period was reintroduced. And Subnautica 2’s Early Access launch was back on now confirmed for May 14, 2026.
